Underage DUI

Underage DUI Many states have laws regarding underage DUI. These laws are separate from drunk-driving laws for drivers over the age of 21, and are sometimes referred to as “Zero Tolerance” laws.

For drivers over the age of 21, it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of .08 percent or higher. However, the legal limit for someone under the age of 21 is .02 percent – four times lower than the BAC limit for an adult.

It is important to note that in some states, a motor vehicle is classified as a car, boat, motorcycle, or even an airplane.

Because it is a combination of two different crimes—driving under the influence and underage alcohol consumption—the punishment for a minor charged with underage DUI is different than for an adult.

Though the penalties for underage DUI vary from state to state, there are common punishments. For example, the minor’s driving privileges may be suspended or revoked for a period ranging from 90 days to 3 years. The judge may also order the offender to attend alcohol and driving classes (otherwise known as “DUI School”).

Other penalties include performing 30 to 60 days of community service, paying fines ranging from $100 to $2,000, and paying any fees associated with the penalties. In some cases, the offender may spend 48 hours to 1 year in jail, and be placed on probation for 3 months to 5 years.

In addition to the court-mandated penalties, a minor may face other consequences. For example, a driver with a DUI on his or her record may be considered high risk. Because of this, an automobile insurance provider may raise the driver’s rates or drop his or her coverage altogether. Without insurance, the driver will no longer be able to drive legally.

If you or a loved one has recently been charged with underage DUI, you may wonder if you need to hire a DUI defense attorney. Because the penalties for drinking and driving are so severe, it may be in your best interest to hire an attorney who is experienced with DUI laws in your state. A skilled attorney may be able to have your charges minimized or even dropped completely.
