Ignition Interlock Device
If convicted of driving under the influence, you face several DUI penalties. These include jail time, probation, community service, alcohol treatment, fines, and the loss of driving privileges. In certain cases, the judge may also order you to have an ignition interlock device installed in your vehicle. An ignition interlock device is very similar to a breathalyzer test. It is a small portable device that is used to measure your blood alcohol content (BAC). Should your BAC be over a preset level, your car will not start. The preset limit varies from jurisdiction to jurisdiction, but is typically between .02 and .04.
The device is normally installed in a vehicle’s dashboard. In order to take the test, you will blow into a plastic tube, which collects the breath sample for testing. It is almost impossible to “trick” the ignition interlock device or circumvent it – in fact, the machine records any attempts to tamper with the device and reports it to your probation officer.
After completing the initial breath test that is required to start the vehicle, you will be required to take a rolling test, or re-test. This means that after you have started driving, the device will signal for you to take the test again. This safety precaution is in place to keep the driver from having his or her friend take the test in order to start the car. Should the driver fail the rolling test, the alarm will sound and the lights will flash until the driver pulls over. It does not automatically turn off the car because doing so would be dangerous for the driver. The flashing lights and the horn may also grab the attention of any law enforcement officers in the area.
Unless their BAC was over .15%, first-time offenders are not typically required to have an ignition interlock device installed in their vehicles. Habitual offenders may be required to have the device installed in order to have their driver’s license reinstated.
The cost of the installation and maintenance of the ignition interlock device comes directly out of the offender’s wallet. The installation typically runs between $100 and $200, while the rental fees range from $70 to $100 per month. The fees for the maintenance and calibration of the device are separate.
